An Official (or Court) Liquidation (“OL”) occurs when either the Federal Court or the Supreme Court of Western Australia exercises its discretion to order the winding up of the company.
The application for the winding up Order can be made by:
- a creditor;
- a shareholder;
- a director; and / or
The duly appointed Official Liquidator appointed by the Court will wind up the affairs of the company and carry out the relevant investigations.
The person who becomes the Official Liquidator of the company is usually nominated by the applicant and is appointed by Order of the Court. That person must be registered as an Official Liquidator of the Court that makes the appointment.
